1. Acceptance of Terms
By downloading, installing, or using Oh My Stuff ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you ("User" or "you") and the developer of Oh My Stuff ("we," "us," or "our"), and are governed by the laws of the European Union and applicable member state legislation.
2. Description of the App
Oh My Stuff is a mobile application that allows you to track and monitor the cost of your personal items over time. The App is available exclusively on the Apple App Store for iOS devices.
All data you enter into the App is stored locally on your device only. We do not collect, transmit, store, or process any of your personal data or item information on external servers. No account creation or login is required to use the App.
3. Eligibility
You must be at least 16 years of age to use this App. By using the App, you confirm that you meet this requirement. If you are under 16, please do not use the App.
4. Subscriptions and Payments
4.1 Free and Premium Access
Oh My Stuff is free to download and may offer certain features at no cost. Additional features may be unlocked through a subscription, which is offered on a recurring basis (e.g., monthly or annual).
4.2 Billing via Apple
All subscriptions are processed and managed exclusively through Apple's In-App Purchase system. By subscribing, you agree to Apple's Terms of Sale and Privacy Policy in addition to these Terms. We do not have access to your payment information.
4.3 Subscription Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
4.4 Managing or Cancelling Your Subscription
You can manage or cancel your subscription at any time via your Apple ID account settings on your device. Cancellation takes effect at the end of the current billing period — you will retain access to premium features until that date.
4.5 Refunds
All refund requests are handled by Apple in accordance with their policies. We do not issue refunds directly. To request a refund, please visit reportaproblem.apple.com.
4.6 Price Changes
We reserve the right to modify subscription prices. Any price changes will be communicated in advance and will take effect upon your next renewal, in accordance with applicable EU consumer protection law.
5. Data Storage and Privacy
5.1 On-Device Storage Only
All data you create or enter within Oh My Stuff — including item names, costs, and any related records — is stored exclusively on your device. We have no access to this data.
5.2 No Personal Data Collected
We do not collect, process, or store any personal data about you. No account, login, or registration is required. As a result, we do not maintain any user profiles or databases containing your information.
5.3 Data Loss
Because your data is stored locally on your device, we are not responsible for any loss of data resulting from device damage, loss, theft, factory resets, iOS updates, or App deletion. We strongly encourage you to back up your device regularly using iCloud or iTunes.
5.4 Analytics
The App may use anonymised, aggregated analytics provided by Apple (e.g., App Store Connect analytics) that do not identify individual users. This data helps us understand how the App is used in general terms.
6. Intellectual Property
All content, design, code, trademarks, and branding associated with Oh My Stuff are the exclusive property of the developer. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes only.
You may not copy, modify, distribute, sell, reverse engineer, or create derivative works based on the App or any part of it without our prior written consent.
7. Acceptable Use
You agree to use the App only for its intended, lawful purposes. You must not:
- Attempt to reverse engineer, decompile, or disassemble the App
- Use the App for any fraudulent or unlawful purpose
- Attempt to circumvent subscription features without payment
- Interfere with the App's normal operation
8. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that:
- the App will function without interruption, errors, bugs, or defects;
- the App will be compatible with any specific iOS version, device model, or future Apple software updates;
- the App will meet your expectations or requirements;
- any errors or malfunctions in the App will be corrected;
- the App will be available at any given time or in any given location.
The App is intended as a personal item cost-tracking tool only. It does not provide financial, legal, investment, or accounting advice, and should not be relied upon as such.
9. Limitation of Liability
To the fullest extent permitted by applicable EU law, the developer of Oh My Stuff, and any individuals, collaborators, contractors, advisors, or other parties associated with the development, distribution, or maintenance of the App (collectively, "the Parties"), shall not be liable for any damages or losses of any kind arising out of or in connection with:
- the use of, or inability to use, the App;
- any malfunction, crash, error, bug, or unexpected behaviour of the App;
- incompatibility of the App with any device, iOS version, operating system update, or third-party software;
- loss, corruption, or accidental deletion of data stored on your device;
- any interruption or discontinuation of the App or any of its features;
- any decision or action taken by you based on information or data displayed within the App;
- unauthorised access to your device or the data stored on it;
- any event beyond our reasonable control, including but not limited to hardware failures, iOS changes, or App Store policy modifications.
This limitation applies to all types of damages, whether direct, indirect, incidental, consequential, punitive, or special, and whether or not the Parties have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable mandatory law.
10. Consumer Rights (EU)
If you are a consumer resident in the European Union, you may have statutory rights that cannot be waived by contract. Nothing in these Terms affects your rights under applicable EU consumer protection legislation, including the Consumer Rights Directive and applicable national laws.
Under EU law, you have a 14-day right of withdrawal from subscription purchases. However, by starting to use premium features immediately after purchase, you may expressly consent to waive this right. Where this right applies, you may contact us at support@ohmystuff.app to exercise it.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this document. We may also notify you through the App or the App Store listing. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
12. Termination
We reserve the right to discontinue or modify the App at any time. If the App is discontinued, subscriptions will be managed in accordance with Apple's policies.
You may stop using the App at any time by deleting it from your device.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the European Union and the applicable laws of the developer's country of establishment. Any disputes shall first be attempted to be resolved amicably by contacting us at support@ohmystuff.app.
If a dispute cannot be resolved amicably, EU consumers may also access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
14. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the developer and any associated individuals or parties from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to your use or misuse of the App, your violation of these Terms, or your violation of any applicable law or regulation.
15. Third-Party Services
The App operates on the iOS platform and relies on Apple's infrastructure, including the App Store and In-App Purchase system. We are not responsible for the availability, performance, policies, or conduct of Apple or any other third-party service. Your use of Apple's services is subject to Apple's own Terms and Conditions.
16. No Guarantee of Continued Service
We reserve the right to modify, suspend, or permanently discontinue the App or any of its features at any time, with or without prior notice, and without liability to you. In the event of permanent discontinuation, active subscriptions will be handled in accordance with Apple's policies.
17. Force Majeure
We shall not be held liable for any failure or delay in the performance of the App or our obligations under these Terms arising from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, changes in Apple's App Store policies, power outages, internet disruptions, or other force majeure events.
18. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible. The remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms constitute the entire agreement between you and us regarding the use of the App and supersede any prior agreements, representations, or understandings, whether written or oral, relating to its subject matter.
